Terms and conditions
The terms on which orders are accepted and carried out.
Last updated:
1. Scope
These terms apply to all quotations, deliveries and services provided by Printerking to its customers. Differing customer terms apply only where they have been expressly agreed to in writing.
The version available on this website when the order is placed is the one that governs.
2. Quotation and formation of contract
The presentations on this website are not binding offers but an invitation to enquire. A contract is formed once I have priced your enquiry in a written quotation and you accept it.
Quotations are valid for thirty days unless stated otherwise. They are based on the information and files you have supplied. If preparing for production shows that a part cannot be made as submitted or would cause substantial additional effort, I will come back to you before work begins.
3. Prices and payment
All prices are in Swiss francs. Shipping and packaging costs are stated separately in the quotation.
No value added tax is charged or shown: Printerking is not liable for VAT. The amounts stated are therefore the final amounts.
Invoices are payable within ten days of the invoice date without deduction. For first orders and for bespoke work a deposit or advance payment may be required; this is recorded in the quotation.
4. Deadlines and delivery
Lead times are stated in the quotation. They begin once all information and files required for production are available and any deposit has been received.
Deadlines are met to the best of my ability. Delays caused by events outside my control, such as machine failure, material supply shortages or transport disruption, extend the deadline appropriately. I will inform you without delay if a delay becomes apparent.
Risk passes to you upon handover to the carrier.
5. Your documents and third-party rights
You warrant that you are entitled to have the submitted data manufactured and that doing so infringes no third-party rights, in particular no copyright, trade mark, design or patent rights.
If third parties bring claims against me because an order infringes such rights, you shall indemnify me.
I reserve the right to decline orders without stating reasons. This applies in particular to items whose manufacture or possession is prohibited, to functional weapons and weapon parts, and to parts whose failure would directly endanger people and for which I hold no suitable qualification.
6. Confidentiality
Your design data, drawings and information are treated confidentially, are not passed to third parties and are used solely to carry out your order.
Publication as a reference, for instance with a photograph on this website, happens only with your express consent in the individual case.
7. Properties of manufactured parts
Additive manufacturing has inherent characteristics that do not constitute defects:
- Layer structures are visible and tangible on the surface.
- Marks may remain where supports were removed.
- Colour tones may vary slightly between production batches.
- Strength is direction-dependent: parts bear less load across the build direction than along it.
Unless otherwise agreed in the quotation, a dimensional tolerance of ±0.2 mm over 100 mm of edge length applies; proportionally more on longer parts. Tighter tolerances are possible but must be agreed before the order is placed, as they affect both process and price.
You assess whether a part is suitable for a particular purpose. I advise on this to the best of my knowledge; any assurance of specific properties requires the written form.
8. Inspection and notice of defects
Please inspect delivered parts immediately on receipt. Obvious defects must be reported within ten days, hidden defects immediately upon discovery. A late notice counts as approval of the delivery.
Where a notice is justified, I will rework or remanufacture. If that fails twice, you may withdraw from the contract or claim a reduction.
9. Liability
I am liable to the full extent of the law for damage caused intentionally or through gross negligence, and for personal injury.
Otherwise liability is limited to the order value. Liability for indirect damage, lost profit, production downtime and data loss is excluded to the extent permitted by law.
No liability is accepted for damage arising because a part is used for a purpose that was not known when the order was placed.
10. Retention of title
Delivered parts remain my property until payment has been received in full.
11. Cancellation
Manufactured parts are bespoke items made to your specification. There is therefore no right of return.
As long as production has not started, you may cancel an order free of charge. After that, the material and labour costs incurred up to that point will be invoiced.
12. Courses
For booked courses the following applies in addition: cancellation up to seven days before the date is free of charge. After that half the course fee falls due, and the full fee in case of non-attendance. If I have to cancel a course, an alternative date will be offered or the amount paid refunded in full.
13. Governing law and place of jurisdiction
Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction is the provider’s registered office, unless mandatory statutory provisions require otherwise. Mandatory places of jurisdiction protecting consumers are reserved.
Should any provision of these terms be invalid, the remaining content is unaffected.
